We ("Application", "us", "our" or "we") are dedicated to protecting the privacy rights of our users ("Users", "you"). This Privacy Policy ("Policy") describes how and why we collect, use, store, disclose, and manage the information and data that you provide or we collect when you use our Application. Please note that the scope of this Policy is limited to information and data collected or received by us through your use of the Application. We are not responsible for any actions of any third parties, the content of their websites, the use of information or data you provide to them, or any products or services they may offer. Any link to those sites does not represent our sponsorship of, or affiliation with, those people or companies.

1. INFORMATION WE COLLECT

We collect the following types of information about you:

1.1Personal Information

Personal information can include: name, postal address, telephone number or email address. We can also receive information about your interest in and use of various products, programs, services, and content available. Such personal data will only be collected when:

(a) you voluntarily provide us with the information;

(b) the information is needed for us to deliver the service you have requested.

Your prior consent is necessary if we are to use such data in actions not mentioned above.

Our app may share some of user's personal data with Apple in the Send Consumption Information API to assist with reviewing the user’s app refund requests. Apple retains the data we provide through the Send Consumption Information API for the period necessary to fulfill the purpose for which the data was collected, which is to improve the refund process by obtaining data that assists with reviewing the user’s refund request. Apple may share the data our app provides through the Send Consumption Information API with service providers who act on Apple's behalf or Apple's partners. Apple will not share the data with third parties for their own marketing purposes.

If you wish to withdraw consent, please send us an email to let us know and we will update and stop sending any further data from you. If you request access to or deletion of your personal data related to consumption information, you may submit requests directly to Apple by visiting privacy.apple.com.

1.2Metadata

Metadata is usually technical data that is associated with your use of the Application. Metadata describes how, when and by whom a piece of user content was posted and how that content is formatted. Such data is used by us for the sole purpose of improving and developing the core features of the Application. But such data won’t be related to certain users, and we won’t track certain users by such data.

1.3Log Data

To track how our service is accessed and used, we adopt third-party analytics tools such as Google Firebase to harvest user behavior data such as the web pages you visit, add-ons, and other information that assists us in improving the service. This information is non-personally identifiable and will not be used to track individual user.

1.4Third-party Services

Our advertising partners may use cookies and other tracking technology to compile information about your device’s visits and usage patterns on our service, to personalize the advertising content shown to you. Sharing the information with these third parties does not constitute the collection or storage of this data by us. In the event of the software development kits (“SDKs”) incorporated into our Application from our advertising partners being updated, we will integrate the new features in time, so as to keep you updated on how your data will be used by these third parties.

1.5Machine Learning Features

We provide you with features such as Eye-Points Recognition and Facial Detection, which are developed on the basis of machine learning technology. We do not harvest or compile user data, such as images or videos you use in your phone. Your data will not be transmitted to our servers when using the features. All our functions are developed and improved based on famous legal open data, we don’t use users’ data for developing purpose. So, we don’t upload, collect, save or share any of your data.

2. MORE EXPLANATION

2.1 We may collect necessary information for different purposes, including:

To enable you to use the functions of this application smoothly: Image and video processing apps often need to use deep learning technology. This app has currently developed or may develop functions that use deep learning related technologies in the future. Since the deep learning technology used in these functions requires a high-performance server to process, you need to upload pictures or videos to the server for processing. These functions include but are not limited to: AI depth beautification/AI painting/Quality Enhancement/Anime Filter/AI Teeth/AI Smile/AI Portrait Editing Picture, etc. When using these features, the app will ask for your permission if it needs to access your device's photo library.

2.1.1How do we handle personal pictures and videos uploaded to the server:

The uploading and processing of this information is necessary to provide these functions. And we will follow the legal requirements and take strict measures for the transmission and storage of your such information. We will encryption measures to keep your information safe.

2.1.2The use of such information

The use of such information is limited to providing you with these functional services. After the service is completed, the above information will be automatically deleted by the system and will not be retained anymore. These images are automatically deleted from our servers after 24 hours. Images and videos generated by the app from your uploaded images and videos are automatically deleted from our servers after 15 days. The technology implemented in the application does not allow for unique identification or authentication of individual users.

2.1.3 Future developments of these functions

For the training and improvement of deep learning-related functions, we all use public compliance data sets, or specially purchased legal data sets. The pictures/videos uploaded by users will not be used for any purposes other than the use of the functions themselves, including using for the training or improvement of functions.

2.1.4 Responsibility for the content of uploaded information

Please guarantee that you have the corresponding legal rights to the uploaded content or have obtained legal authorization from others and have the right to use the above functions. Otherwise, all the consequences and losses caused will be borne by you.

2.1.5 We will not share any information related to 2.1 with any company, organization or individual, except in the following cases:

- Sharing with explicit consent: After obtaining your explicit consent, we will share your personal information with other parties.

- Sharing under statutory conditions: We may share your personal information externally in accordance with laws and regulations, the need to resolve litigation disputes, and in accordance with the mandatory requirements of government authorities or judicial authorities.

-To the extent required or permitted by law, it is necessary to provide your personal information to a third party in order to protect the interests, property or safety of the Concrete, its users, or the public from damage.

2.1.6 User Face Data Statement

For most editing features in our app, face-related data is processed only when users use face-related retouch or enhancement functions. The data is temporarily retained in local device during a single editing session to expedite the process for users utilizing multiple face retouch features. Once users complete an edit or exit the editing page, the face data is immediately deleted. Every feature we offer is built and optimized using well-established legal open data; we refrain from using user data for development-related purposes.

(a) For some deep learning features including AI depth beautification/AI painting/Quality Enhancement/Anime Filter/AI Teeth/AI Smile/AI Portrait Editing Picture, etc., these features need cloud-based process to reach users' needs. Such uploaded content is used solely to provide the editing, enhancement, or generated result requested by the user. We protect data during transmission and storage through security measures such as SSL encryption, data desensitization, and de-identification. Face-related data is not used to identify or verify the identity of any individual. Any user-uploaded images will be automatically deleted from the cloud servers after 24 hours. Notably, the remaining 24-hour is to avoid users exiting the app before the process is completed and losing their edit results. Images and videos generated by the app from your uploaded images and videos are automatically deleted from cloud servers after 15 days.

(b) Face Data Statement: We do not store, save, or share any user face data, either by ourselves or with any third parties. The app accesses facial data solely to power face editing and enhancement features. During a single editing session, such data is temporarily cached on your local device to optimize multi-feature workflows; it is immediately deleted once you finish editing or exit the editing interface.

(c) Feature Training and Improvement: Training and optimization for our deep learning and deep synthesis features rely exclusively on public, compliant datasets or legally acquired proprietary datasets.Unless we obtain your explicit consent, your uploaded images or videos will not be used for any purpose other than providing the requested feature, including model training or feature improvement. If such use is needed in the future, we will request your consent through a clear notice such as a pop-up window. If you decline, your data will not be used for such purposes. You may also revoke your consent at any time through the Settings page.

2.2 To improve our Apps and quality (for example, by performing statistical analyses)

In order to ensure the quality and stability performance of service and improve our applications, we will use Google Firebase or Flurry SDK to collect, analyze, correct faults and errors and help to reduce illegal use or abuse of applications. And we will collect statistical data on user usage functions, which will not be tracked Individual users, but based on aggregate statistics for all users.

2.3 Handling and Responding to Customer Support Communications.

In order to help users deal with problems encountered during using, we will collect the identity information and contact information (such as name, email address) which you provide to us, as well as the content of your communication or request. We only use this data for user support and if the case is closed we will delete it within 1 year.

2.4 Analyze your usage information, including your preferences, interests and behaviors when using our products.

3. INFORMATION WE SHARE

We do not disclose user information to third parties without permission from you in exclusion of the following instances. Please note that the processing of your information by any third parties will have to comply with our policies:

(a) we may sell, transfer, or otherwise share some or all of our business or assets, including your personal information, in connection with a business transaction (or potential business transaction) such as a corporate divestiture, merger, consolidation, acquisition, reorganization or sale of assets, or in the event of bankruptcy or dissolution. Notices will be sent to you before such transfer is actualized;

(b) we may share your information with our advertising partners who collect information from your device to improve the display of advertisements on the Application and elsewhere online;

(c) with respect to jointly offered services or functionality or services offered separately by other companies through our Application, we may share information about you with business partners to provide the services and functionality you request and to communicate with you about those services;

(d) we may share information about you in response to legal process or a request for information if we believe disclosure is consistent with, or required by, any applicable law, rule, or regulation; to investigate or remedy potential violations of our user agreements or policies, or to protect the rights, property, and safety of us, our users, or others.

4. SECURITY OF INFORMATION

We maintain security measures consistent with industry standards and have established internal procedures to protect personal information against unauthorized access, disclosure, use, alteration, damage, or loss. Our specific measures include:

(a) Technical Safeguards: Data transmission between your browser/device and our app services is secured via SSL encryption. Our web services exclusively support HTTPS. We employ advanced encryption to ensure data confidentiality, utilize trusted protection mechanisms to repel malicious attacks, and enforce strict access control policies to ensure only authorized personnel can access personal information.

(b) Administrative Safeguards: We maintain internal information security policies, define personnel responsibilities, provide regular privacy and security training, and restrict access to personal information to authorized personnel only.

(c) Incident Response: In the event of a personal information security incident, we will take appropriate remedial measures and, where required by applicable law, notify affected users of the nature of the incident, its possible impact, the measures taken or to be taken, and recommendations for reducing risk. We may provide such notice by email, letter, phone, push notification, or public announcement, as appropriate.

(d) Please note that no method of transmission over the Internet or method of electronic storage is completely secure. While we make reasonable efforts to protect your information, we cannot guarantee absolute security.

(e) Data Retention：We retain personal information only for as long as necessary to fulfill the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. After the applicable retention period expires, the information will be deleted or anonymized in accordance with applicable law.

(f) For features involving uploaded images or videos, including personal facial images where applicable, uploaded content will be deleted from our servers within 24 hours after upload. This retention period is necessary to complete processing, address processing errors, and allow users to retrieve results if processing or download is interrupted. Images and videos generated from uploaded content will be deleted from our servers within 15 days.

(g) Personal information processed for app improvement and quality assurance, including analytics, user support, and analysis of your preferences, interests, and usage behavior, will be retained for no more than two years after your relationship with us ends.
